NOTICE IS HEREBY GIVEN that the Division of Hotels and Restaurants, Department of Business and Professional Regulation has received the petition for declaratory statement from Ocean Reserve Condominium Association, Inc., docket number 2013015058 (DS 2013-025), filed on April 1, 2013. The petition seeks the agency's opinion as to the applicability of Section 509.013, Florida Statutes, and Section 509.242(e), Florida Statutes as it applies to the petitioner.

Petitioner requests clarification on whether petitioner would be considered a transient or nontransient public lodging establishment or transient apartment based upon rental of individual units that petitioner does not own or operate, when petitioner is responsible for certain building operations.
