    Construction Industry Licensing Board

    The Construction Industry Licensing Board hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on October 30, 2015, by Brooks Michael Myers. The Notice of Petition for Waiver or Variance was published in Vol. 41, No. 218, of the November 9, 2015, Florida Administrative Register. Petitioner sought a waiver or variance of Rule 61G4-16.005, F.A.C., which requires for the purpose of certification, a passing grade shall be valid only for a period of four (4) years from the date the list of successful candidates is approved by the Board. The Board considered the instant Petition at a duly-noticed public meeting held on January 15, 2016, in Cocoa Beach, Florida. The Board’s Order, filed on March 31, 2016, denied the petition finding that Petitioner had not demonstrated a substantial hardship or is affected in a manner significantly different from the way the rule affects other similarly situated persons who are subject to the rule. In addition, the Petition has not shown how application of the rule creates a substantial hardship or violates principles of fairness.
