65C-22.001General Requirements
The Department of Children and Families hereby gives notice: An order was issued on April 4, 2024 that disposes of the petition for variance from sections 3.4.4 and 3.5 of the Child Care Facility Handbook, which is incorporated by reference in subsection 65C-22.001(6), Florida Administrative Code, from BRBMember. The Notice of Petition for Variance was published on March 13, 2024, in Volume 50, Number 51 of the Florida Administrative Register. Those sections require, in pertinent part, a child care facility to have an outdoor play area.
The petition for variance was denied because Petitioner did not demonstrate a substantial hardship, violation of principles of fairness, or that the underlying purpose of the statute will be achieved.
