    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 41 No. 63, April 1, 2015 issue of the Florida Administrative Register.

    The changes are in response to comments received by the Joint Administrative Procedures Committee and those received at the public hearing on this rule.

    The rule has been changed as follows:

    (2) The second sentence shall now read: For parental complaints, the coalition shall utilize the criteria in the monitoring tool category that relates to the complaint and may monitor additional categories if the coalition deems additional review is appropriate.

    The rulemaking authority will be changed to add: Sections 1002.85(2)(h) and 1002.84(15), F.S.

    Form OEL-SR 20M has substantial changes. Changes to the form includes language: in section A., referencing where high risk is defined and clarifying monitoring for parental complaints; in section C., clarifying tier 2 compliance is conducted through random sample with the addition of high risk providers and clarifying where the term high risk provider is defined; clarifying language of what constitutes a high risk indicator in section D.; in Attachment A, adding references to local licensing agencies where applicable; in Attachment A, II.4., revising language relating to review of public assistance fraud and where to locate the information; in Attachment A, III.1.,6., 8.,9.,10.,V.2., and (renumbered)VI.4. , adding language clarifying what will constitute a finding; in Attachment A, III.2.d. and e., and 11., adding federal and state statutory references; in Attachment A, IV., removing reference to coalition responsibilities regarding training and technical assistance; in Attachment A, (renumbered) VIII., Notification, adding language of location for definition of unusual incident; and in Attachment A, (renumbered) IX., Insurance, clarifying insurance requirement monitoring.
