PURPOSE AND EFFECT: The proposed rulemaking seeks to amend existing Rule 61-35.011, F.A.C., in order to update and revise application forms DBPR COSMO 1, COSMO 4-A and COSMO 4-B, to ensure consistency with a recent amendment to Rule 61G5-29.004, F.A.C.

SUMMARY: Within the provided paragraph the Department proposes to amend Rule 61-35.011 to adopt the forms.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the economic review conducted by the Agency

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(1) Any person desiring a cosmetology license based on Florida education shall submit to a completed Form DBPR COSMO 1, Application for Initial License Based on Florida Education, effective XX/XX/XXXX October 2022, adopted and incorporated by reference, and available at

(2) through (3) no change.
