64V-1.003Birth Certificate Amendments; Documentary Evidence Requirements
The Department of Health hereby gives notice: On April 18, 2024, the Department of Health issued an Order in response to a petition for a variance or waiver filed on January 19, 2024, by Adam B. Cordover, Esquire, on behalf of E.T., seeking a permanent variance from subsection 64V-1.003(2), Florida Administrative Code, which requires documentary evidence for birth certificate amendments. Notice of the petition was published February 14, 2024, in Volume 50, Number 31, of the Florida Administrative Register. The Department found the Petitioner did not demonstrate a substantial hardship, that application of the rule violates principles of fairness, and that the underlying intent of the statute has been met. Therefore, pursuant to the requirements of section 120.542(2), Florida Statutes, the Department DENIED the Petitioner's request for a permanent variance.
