64B8-51.001Manner of Application
The Board of Medicine hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on January 24, 2024, on behalf of Roberta Graham, CPE, CME, CCE, CLHRP. The Notice of Petition for Variance or Waiver was published in Vol. 20, No. 55, of the February 6, 2024, Florida Administrative Register. Petitioner sought a variance and or wavier from subsection 64B8-51.001(2), F.A.C., which requires that all applications must include an official transcript from a school of electrology which identifies the credits taken by home study or correspondence courses and those taken in classroom settings. The Board considered the Petition at a duly-noticed meeting held on April 5, 2024. The Board’s Order, filed on May 6, 2024, grants the petition for waiver or variance from subsection 64B8-51.001(2) and paragraph 64B8-51.002(1)(e), Fla. Admin. Code. The Board finds that Petitioner has met the purpose of the underlying statutes. The Board also finds that the literal application of the rule in question would place a substantial hardship upon the Petitioner who through no fault of her own cannot obtain a copy of her official transcript from Pittsburgh due to forces beyond her control.
