NOTICE IS HEREBY GIVEN that the Florida Department of Corrections has declined to rule on the petition for declaratory statement filed by inmate Daniel Howe, DC#R00932, on May 1, 2014. The following is a summary of the agency’s declination of the petition:

Pursuant to subsection 120.81(3), Florida Statutes, the Department lacks jurisdiction to issue a declaratory statement to inmates. As an inmate of the Florida Department of Corrections, Daniel Howe, DC#R00932 may only participate in administrative proceedings pursuant to paragraph 120.54(3)(c) and subsection (7), Florida Statutes.
