NOTICE IS HEREBY GIVEN that on March 18, 2016, the Division of Pari-Mutuel Wagering, Department of Business and Professional Regulation, has received the petition for declaratory statement from Petitioner West Flagler Associates, LTD., in DBPR Case No. 2016016786 (DS 2016-020). The petition seeks the agency's opinion as to the applicability of Chapter 551, F.S., as it applies to the petitioner.

Petitioner seeks a determination as to whether section 23, art. 23, Fla. Const., and section 551.102(4), F.S., allow Petitioner to operate slot machines at its Facility were it to discontinue its greyhound operation and instead operate a full schedule of jai alai performances. Any person whose substantial interests may be affected by a declaratory statement on the subject matter of the Petition may file a motion to intervene within 21 days of the publication of this notice.
