NOTICE IS HEREBY GIVEN that on April 08, 2010, the Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety, received a petition for a variance from Christopher Zachritz on behalf of the City of West Palm Beach Banyan Parking Garage in West Palm Beach. Petitioner seeks a variance of the requirements of ASME A17.3, Section 3.11.3 and A17.1, Section 2.2.2.5, as adopted by Chapter 30, Section 3001.2 Florida Building Code adopted by paragraph 61C-5.001(1)(a), Florida Administrative Code, requiring Fire Fighter Service Phase I & II and a sump pump in the pit. Petitioner states that additional time is needed to arrange to complete the work or sell the building.
