    The Department of Highway Safety and Motor Vehicles hereby gives notice: On April 22, 2020, the Department of Highway Safety and Motor Vehicles issued a final order in response to a petition for rule variance or waiver filed by West Central Florida Driver Improvement, Inc. The petition, which was received by the Department on March 23, 2020, and noticed in Volume 46, Number 68, of the Florida Administrative Register on April 7, 2020, requested variance from or waiver of paragraph 15A-10.014(2)(d), Florida Administrative Code. Paragraph 15A-10.014(2)(d) prohibits contributions to retirement by a DUI program in excess of the percentage of gross compensation contributed by the employer of members of the Regular Class of the Florida Retirement System pursuant to section 121.071, Florida Statutes. The Department found that the petition demonstrated that the purpose of the underlying statute will be or has been achieved by other means and that strict application of paragraph 15A-10.014(2)(d) would create a substantial hardship for the petitioner or would otherwise violate principles of fairness.
