  • NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Peter J. Trapani, Vice President of Whitehall Condominiums of Pine Island Ridge II Association, Inc. on March 06, 2009. The following is a summary of the agency's declination of the petition:
    The Division declined to issue an order because the Division was not provided the governing document and, therefore, lacks authority to issue a declaratory statement when the record contains no competent substantial evidence to support the declaration; where issues have already taken place; where facts are in dispute; or where owners who will be affected by the decision are not parties to the petition.
