NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Joseph E. Adams, attorney for St. Kitts Condominium Association, Inc., on April 22, 2009.The petition seeks the agency's opinion as to the applicability of Section 718.110(9), as it applies to the petitioner.
Whether St. Kitts Condominium Association, Inc. may approve amendments to the declaration of condominium correcting an ambiguous drafting error or omission to clearly designate terraces and screen porches as part of the unit and not part of the common elements under Section 718.110(9), Florida Statutes.
