NOTICE IS HEREBY GIVEN that Department of Business and Professional Regulation has received the petition for declaratory statement from Paul Handerhan on April 21, 2016. The petition seeks the agency’s opinion as to the applicability of 468.8419, F.S., as it applies to the petitioner.
Petitioner asks for the Department’s interpretation as to whether providing pre-mold and/or post mold assessments for a property owner while concurrently providing public adjusting services would violate any provision of 468.8419, F.S. if the fees for two separate services complied with the public adjusting fee cap as outlined in 626.854(11)(b), F.S. and the combined services were fully disclosed to both the policyholder and the insurer.
