NOTICE IS HEREBY GIVEN THAT on May 6, 2019, the Board of Medicine issued a Final Order on the petition for declaratory statement filed on behalf of Julio Pabon, M.D. The Notice of the Petition was published in Volume 44, No. 205, of the October 19, 2018, issue of the Florida Administrative Register. The Board reviewed the Petition at its meeting held on February 5, 2019. The Board’s Final Order finds that as long as the Petitioner and his employees/agents make no attempt to persuade patients to use Fertility Pharmacy of America and the Petitioner properly discloses his ownership interest, the practice set forth in the petition does not violate Section 456.053, Florida Statutes.
