NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Darrell K. Beaty, Unit Owner, In Re: Laurel Oaks at Country Woods Condominiums Association, Inc., Docket No. 2017022926, filed on May 11, 2017. The petition seeks the agency’s opinion as to the applicability of Section 718.113(2)(a), Florida Statutes, and Section 718.111(12), Florida Statutes, as they apply to the petitioner.
Whether the Association is in violation of Section 718.113(2)(a), Florida Statutes, for failing to replace gutters and a drip edge. Whether the Association was required to obtain a 75% vote in order to permanently remove gutters and a drip edge. Whether the Association’s Declaration requires that each person affected by the removal of the gutters and 75% of those unaffected must vote to remove the gutters in order for the association to permanently remove the gutters. Whether the Association is in violation of Section 718.111(12), Florida Statutes, for failing to provide access to official records of the Association, by refusing to turn over records of attorney opinions regarding replacement of gutters.
