The Board of Medicine hereby gives notice:

that on May 11, 2018, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by John T. Bowman, M.D., on February 8, 2018, seeking a waiver or variance from paragraph 64B8-8.0011(7)(a), F.A.C., with regard to the requirement for the supervising physician to be practicing within 20 miles of the physician being supervised. The Notice was published in Volume 44, No. 37, of the Florida Administrative Register, on February 22, 2018. The Board, at its meeting held on April 6, 2018, voted to grant the Petition for Waiver finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that the purpose of the underlying statute has been met.
