64B8-52.003Procedure for Approval of Attendance at Continuing Education Courses

The Board of Medicine hereby gives notice:

that on May 11, 2018, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by Peggy Daniel, on February 20, 2018, seeking a permanent waiver or variance from Rule 64B8-52.003, F.A.C., with regard to the restriction on the number of continuing education hours which may be completed via home study. The Notice was published in Volume 44, No. 37, of the Florida Administrative Register, on February 22, 2018. The Board, at its meeting held on April 6, 2018, voted to deny the permanent waiver, but granted a temporary waiver for a period of one year, finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that the purpose of the underlying statute has been met.
