The Agency for Health Care Administration hereby gives notice:

That on May 10, 2016, the Agency for Health Care Administration entered an order disposing of the petition for variance filed by Tallahassee Memorial Healthcare, Inc. on February 10, 2016 and advertised in Vol. 42, No. 37, Florida Administrative Register on February 24, 2016. The Petition was assigned Agency Case Number 2016001559. The Agency for Health Care Administration has issued a Final Order Denying Petition for Variance from paragraph 59A-7.034(7)(a), F.A.C, which relates to the requirements for personnel to perform alternate-site clinical laboratory testing. The variance is denied upon a finding that the Petitioner failed to demonstrate that the purpose of the underlying statute will be or has been achieved by other means and that application of the rule to Petitioner would create a substantial hardship or violate principles of fairness.
