    64B13-5.002Criteria for Approval

    The Board of Optometry hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on March 13, 2020, by William Peacock. Petitioner was seeking a waiver or variance from paragraph 64B13-5.002(2)(a), F.A.C., entitled “Criteria for Approval” which lists the criteria or course content for approval of non-transcript quality continuing education programs.

    The Notice was published in Volume 46, No. 53, of the Florida Administrative Register, on March 17, 2020.

    The Board considered the instant Petition at a duly-noticed public telephonic meeting held April 3, 2020. The Board’s Order, filed on April 30, 2020, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute would be met by granting a variance or waiver from paragraph 64B13-5.002(2)(a), F.A.C. The Board further finds that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
