NOTICE OF CHANGE
Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 46 No. 50, March 12, 2020 issue of the Florida Administrative Register.
These changes were made in response to comments received from the Joint Administrative Procedures Committee (March 31, 2020, letter).
Second paragraph of Subsection titled Evidence and Property at page 3 of the manual, so that when adopted, the paragraph will read:
The Department shall ensure the provisions of the Florida Contraband Forfeiture Act, ss. 932.701 – 932.7062, F.S., incorporated by reference herein, and available at [http://to be filled in], shall be used to deter and prevent the continued use of contraband articles for criminal purposes while protecting the proprietary interests of innocent owners and lienholders.
Ninth paragraph of Subsection titled Operational Procedures at page 4 of the manual, so that when adopted, the paragraph will read:
The Department shall maintain compliance with the Americans with Disabilities Act regulations at 28 CFR s. 35.160, incorporated by reference herein, and available at [http:// to be filled in], to provide access to effective communications for deaf/hard-of-hearing persons in all criminal investigations and/or official proceedings.
Eleventh paragraph of Subsection titled Operational Procedures at page 4 of the manual, so that when adopted, the paragraph will read:
The Department shall provide fingerprinting services for the school’s Human Resources Department and maintain compliance with the state legislatively mandated, Jessica Lunsford Act with regards to noninstructional contractors., as mandated by s. 1012.465, F.S., incorporated by reference herein, and available at [http:// to be filled in], s. 1012.467, F.S., incorporated by referenced herein, and available at [http:// to be filled in], and s. 1012.468, F.S., incorporated by reference herein, and available at [http:// to be filled in].
Seventh paragraph of Subsection titled Criminal Justice Information Services at page 6 of the manual, so that when adopted, the paragraph will read:
The Department adopts the FBI’s CJIS Security Policy Manual, effective as of June 1, 2019, incorporated by reference herein, and available at [http:// to be filled in], as the Physical Protection policy for Department personnel, support personnel, and private contractor/vendors with access to Criminal Justice Information (CJI) whether logically or physically.
