Notice of Entry of Final Order Revising Verified Lists of Impaired Waters and Delisting of Waters
The Department of Environmental Protection, Division of Environmental Assessment and Restoration, gives notice that, pursuant to subsection 403.067(4), Florida Statutes (F.S.), and Chapter 62-303, Florida Administrative Code (F.A.C.), a final order was entered on April 30, 2020, revising the Verified List of Impaired Waters for the Group 2 Basins (Apalachicola - Chipola River, Charlotte Harbor, Lower St. Johns, Middle St. Johns, St. Lucie - Loxahatchee River, and Tampa Bay Tributaries), amending the Verified List of Impaired Waters for one waterbody in the Group 3 Upper St. Johns basin and two waterbody segments in the Group 5 Indian River Lagoon basin, and finalizing the assessment determination for two waterbody segments in the Group 1 Ochlockonee-St. Marks basin. The final order entered on April 30, 2020, as well as a comprehensive list of waters verified as impaired or that are being added or removed from the Study List under Chapter 62-303, F.A.C., can be obtained from a link on the following webpage: https://floridadep.gov/dear/watershed-assessment-section/content/news-announcements.
These revisions/amendments will be submitted to the United States Environmental Protection Agency (EPA) pursuant to Section 303(d) of the federal Clean Water Act and shall serve to update the previously approved Section 303(d) list of Florida waters.
A person whose substantial interests are affected by this final order may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S. The petition, which must contain the information identified in the full notice of rights language contained in the final order, must be filed (received by the clerk) in the Department’s Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station #35, Tallahassee, Florida 32399-3000, within 21 days of publication of this notice or within 21 days of receipt of written notice, whichever occurs first.
