    NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by James Bifulco on November 6, 2015. The following is a summary of the agencys disposition of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 41, No. 221, of the November 13, 2015, Florida Administrative Register. The Petitioner seeks a declaratory statement as to whether a general contractor’s license is required to construct temporary structures such as outrigger safety netting, perimeter guardrails and netting systems, protection decks and scaffolds used to stage significant material loads, and shaft and floor hold opening protections used in the course of constructing residential and commercial buildings greater than 1, 2, or 3 family dwellings, and greater than 3 stories in height. The Construction Industry Licensing Board considered the Petition at its meeting held on January 15, 2016, in Cocoa Beach, Florida. The Board’s Order, filed on March 31, 2016, declines to issue a declaratory statement in that the petition is facially insufficient as it does not comply with Section 120.565, Florida Statutes and Rule 28-105, Florida Administrative Code.
