Board of Nursing Home Administrators

The Board of Nursing Home Administrators hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on November 3, 2015 by Negovan Mamic. The Notice of Petition for Variance or Waiver was published in Vol. 41, No. 215, of the November 4, 2015, Florida Administrative Register. Petitioner sought a variance or waiver regarding the requirement of subsection 64B10-16.003(3), F.A.C., that Petitioner’s Administrator-in-Training program take place in a facility with at least 60 beds. The Board considered the instant Petition at a duly-noticed public meeting held on November 20, 2015 by telephone conference call.

The Board’s Order, filed on December 2, 2015, granted the Petition because the Petitioner has demonstrated he meets purpose of the underlying statute by other means and has demonstrated that application of the rule at issue would violate principles of fairness as defined by Section 120.542, F.S. and Chapter 28-104, F.A.C.
