Board of Nursing Home Administrators

The Board of Nursing Home Administrators hereby gives notice of the issuance of an Order regarding the Petition for Permanent Variance, filed on October 3, 2014 and supplemented March 30, 2015, by Carolyn Moore. The Notice of Petition for Variance or Waiver was published in Vol. 40, No. 207, of the October 23, 2014, Florida Administrative Register. Petitioner sought a permanent variance from the requirements of subsection 64B10-15.0021(1), F.A.C., and award of CE credit for the total number of requested hours for the licensure renewal biennium ended September 30, 2014. The Board considered the Petition at a duly-noticed public meeting held on April 17, 2015 by telephone conference call.

The Board’s Order, filed on April 23, 2015, denied the Petition because the Petitioner has not demonstrated how the purpose of the underlying statute has been achieved by other means, nor how application of the rule would create a substantial hardship on Petitioner or violate principles of fairness.
