    Board of Professional Engineers

    The Board of Professional Engineers hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on September 22, 2015, by Ellen H. Kucharik. The Notice of Petition for Variance or Waiver was published in Vol. 41, No. 185, of the September 23, 2015, Florida Administrative Register. Petitioner sought a variance from or a waiver of paragraph 61G15-21.001(1)(a), F.A.C. and licensure as a professional engineer by endorsement. The Board considered the instant Petition at a duly-noticed public meeting held on October 8, 2015, in Daytona Beach, Florida.

    The Board’s Order, filed on November 5, 2015, granted the Petition for a Variance or Waiver because the petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code, the Petitioner met the purpose of the underlying statute based upon her passage of a state Fundamentals of Engineering Examination which is substantially equivalent to Part I of the NCEES licensure examination, and application of the rule would present a substantial hardship on Petitioner.
