    The Board of Chiropractic Medicine hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on February 24, 2014, by Jay M. Littlefield II, D.C. The Notice of Petition for Waiver or Variance was published in Volume 40, Number 46, of the March 7, 2014, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B2-13.007, Florida Administrative Code, which requires that for the purpose of renewing or reactivating a license, an applicant must demonstrate to the Board that he/she has participated in at least forty (40) classroom hours of Board approved continuing chiropractic education, including at least three (3) hours in risk management, and two (2) hours in the area of Florida laws and rules. The Board considered the instant Petition at a duly-noticed meeting, held April 4, 2014, in Orlando, Florida.

    The Board’s Order, filed on April 22, 2014, grants a temporary waiver of Rule 64B2-13.004, Florida Administrative Code. The Board finds that Petitioner met the purpose of the underlying statute and demonstrated that application of the rule at issue to Petitioner would violate principles of fairness. However, the Petitioner must complete two hours of Florida chiropractic laws and rules continuing education by June 30, 2014. This waiver applies to the 2012-2014 licensure biennium only.
