    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Andrew P. Speranzini, Esq., In Re: Toscana West Condominium Association, Inc., Docket No. 2016023215, filed on May 11, 2015. The petition seeks the agencys opinion as to the applicability of section 718.113(1), Florida Statutes, as it applies to the petitioner.

    What is the proper method of allocating the Association’s expenses for maintaining, repairing and/or replacing the air conditioning system servicing the Rear Elevator Vestibules for the 7/8 stack and the payment of electricity services for said air conditioning system pursuant to Section 718.113(1), Florida Statutes, and the Association’s governing documents?
