    NOTICE IS HEREBY GIVEN that on May 3, 2013, the Division of Pari-Mutuel Wagering, Department of Business and Professional Regulation, has received an amended petition for declaratory statement from Petitioner Investment Corporation of Palm Beach in DBPR Case No. 2013007595 (DS 2013-010). The petition seeks the agency's opinion as to the applicability of Chapter 550, F.S., as it applies to the Petitioner, and notice of receipt of Petitioner’s initial petition was published in Vol. 39 No. 45, March 6, 2013 issue of the Florida Administrative Register.

    Petitioner seeks a determination by its amended petition as to whether Chapter 550, F.S., allows an individual or entity to condition Petitioner’s receipt of intertrack or simulcast wagering signals upon payment of “Interface Fees,” as well as whether any individual or entity is authorized under Chapter 550, F.S., to condition Petitioner’s receipt of intertrack or simulcast wagering signals upon payment of a monthly license fee to the Thoroughbred Racing Protective Bureau (TRPB). Petitioner also inquires whether, if it refuses to pay such fees, the Division can fine, suspend, or revoke its pari-mutuel license. All petitions to intervene already filed in this cause need not be re-filed; they will be considered. However, any other person whose substantial interests may be affected by a declaratory statement on the subject matter of the Amended Petition may file a motion to intervene within 21 days of the publication of this notice.
