NOTICE OF CORRECTION
Notice is hereby given that the following correction has been made to the proposed rule in Vol. 46 No. 41, February 28, 2020 issue of the Florida Administrative Register.
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has been prepared by the Agency.
The Agency has determined that the rule will not directly or indirectly increase regulatory costs because the 21st Century Cures Act ("Cures Act") mandates electronic visit verification for personal care services, home health services, or both rendered to clients requiring an in-home visit furnished under the Medicaid HCBS Waiver. The rule merely reflects the requirements articulated in 42 U.S.C. 1396b(l). The rule does not have an adverse impact on small business and is not likely to increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule because the rule adopts a federal standard. Costs are attributed to the Cures Act, not the rule.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein:
A SERC Checklist and SERC were prepared by the Agency to determine the need for legislative ratification. Based on this information at the time of the analysis and pursuant to section 120.541(4)(a), Florida Statutes, the rule will not require legislative ratification as it adopts a federal standard.
