Final Order No. DEO-16-081
NOTICE IS HEREBY GIVEN that the Florida Department of Economic Opportunity issued Final Order No. DEO-16-081 on May 20, 2016, in response to an application submitted by Victoria Park I Property Owners’ Association, Inc. for covenant revitalization under Chapter 720, Part III, Florida Statutes.
The Department’s Final Order denied the application for covenant revitalization after determining that it did not meet the statutory requirements as the Proposed Revived Declaration contains covenants from amendments that occurred after the extinguishment of the original declaration in 2003, which are more restrictive violating Section 720.404(3), Florida Statutes, and the association’s submission lacked the required member voting sheet or documentation of the parcel owners who voted to approve the revitalization, violating Section 720.405(6), Florida Statutes.
