    The Division of Licensing hereby gives notice that on May 18, 2016, the Department issued an Order, granting in-part and denying in-part, a petition for variance filed by The Brantly Corporation on March 22, 2016. Notice of the Petition was published on March 29, 2016, in Volume 42, No. 61, of the Florida Administrative Register. Petitioner sought a variance from paragraphs (1)(b) and (1)(c) of Rule 5N-1.140, F.A.C., which establishes criteria for administering a two-part final examination upon completion of the 40-hour Security Officer Training course. The Division granted The Brantly Corporation’s request to vary paragraph (1)(b), allowing it to administer multiple examinations at desired intervals. The Division also found it necessary to grant Petitioner a variance from paragraph (1)(c) which also referenced a two-part examination. The Division denied Petitioner’s request to adopt a 76% examination passing rate as this would require students to achieve a higher examination score compared to students at other schools.
