NOTICE IS HEREBY GIVEN that Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco has received the petition for declaratory statement from Robert D. Epstein On Behalf of Arnold's Wines Inc., D/B/A Kahn's Fine Wines and SpiritsThe petition seeks the agency's opinion as to the applicability of Florida Statutes subsections 561.545(1) and (2); 561.54(1) as it applies to the petitioner.

Petitioner seeks a Declaratory Statement from the Department with the following questions: Whether an unlicensed, out-of-state retailer can sell, ship, and deliver wine directly to consumers in Florida? If an unlicensed, out-of-state retailer can sell, ship, and deliver wine directly to consumers in Florida, whether the retailer can do so either by using its own vehicle or by common carrier? If an unlicensed, out-of-state retailer may not sell, ship, and deliver wine directly to consumers in Florida, whether an out-of-state winery or retailer may qualify for any type of license that would allow it to do so?
