The Board of Massage Therapy hereby gives notice:
of the issuance of an Order regarding the Petition for Variance or Waiver, filed on February 9, 2018, by Jennifer Lynn Stevens. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 31, of the February 14, 2018 Florida Administrative Register. Petitioner sought a variance or waiver of 64B7-32.003, F.A.C., regarding the 500-hour minimum requirement for board approved massage schools. The Board considered the instant Petition at a duly-noticed public meeting held on April 20, 2018, in Tallahassee, Florida.
The Board’s Order, filed on May 21, 2018, found that the petition was in substantial compliance with the provisions of Section 120.542, F.S., and Chapter 28-104, F.A.C. The Board denies the petition finding that the applicant has not met the purpose of the underlying statute and that the application of the rule to Petitioner does not violate principles of fairness.
