    NOTICE IS HEREBY GIVEN that The Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco has declined to rule on the petition for declaratory statement filed by Brew2U, Inc. on September 5, 2014. The following is a summary of the agencys declination of the petition:

    The Petitioner sought a Declaratory Statement consenting to a business model based on soliciting sales and facilitating delivery of alcoholic beverages from vendors to retail consumers. The scenario described in the Petition is neither specific nor limited to the Petitioner. The Division is unable to exceed the authority granted by the legislature and issue a response that amounts to a rule.
