NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has issued an order disposing of the petition for declaratory statement filed by Timothy J. Sloan, Esq., In Re: The Summit Owners Association, Inc., Docket No. 2016013701, on March 17, 2016. The following is a summary of the agency’s disposition of the petition:
Summit is considered a condominium timeshare plan pursuant to Sections 718.103(11) and 721.05(39), Florida Statutes, and is therefore exempt from the term limits in Section 718.112(2)(d)2., Florida Statutes, and may continue to elect directors for three-year terms.
