    The Agency for Health Care Administration hereby gives notice: On May 26, 2020 the Agency for Health Care Administration entered an order disposing of the petition for variance filed by Plantation General Limited Partnership d/b/a Mercy Hospital, A Campus of Plantation General Hospital on April 29, 2020 and advertised in Vol. 46, No. 87 Florida Administrative Register on May 4, 2020. The Petition was assigned Case Number 2020007823. The Agency for Health Care Administration issued a Final order denying the Petition for Variance of Rule 59C-1.042, F.A.C., which requires a hospital seeking to provide Level III Neonatal Intensive Care Services to establish a Neonatal Intensive Care Unit of at least 15 Level III beds and maintain at least 10 Level II beds. The Petition for Variance of Rule 59C-1.042, F.A.C. is denied upon finding that the Petitioner failed to demonstrate that the purpose of the underlying statute will be or has been achieved by other means and that application of the rule to Petitioner would create a substantial hardship or violate principles of fairness.
