NOTICE IS HEREBY GIVEN that the Florida Office of Financial Regulation has declined to rule on the petition for declaratory statement filed by Vickie Sublett on April 26, 2019. The following is a summary of the agency's declination of the petition: On May 28, 2019, the Florida Office of Financial Regulation issued a Final Order on Petition for Declaratory Statement. The Petition filed by Vicki Sublett. is DENIED. Rule 28-105.001, Florida Administrative Code, expressly prohibits the issuance of a declaratory statement that determines the conduct of a person other than the petitioner. Here, Petitioner seeks the Office's determination as to the applicability of subsection 658.12(20), Florida Statutes, to the actions of Sun Coast, a third party. The Petition must be denied because a petition for declaratory statement is not the proper means for determining the conduct of a third party.******The original petition was published April 30, 2019 in the Florida Administrative Register Volume 45, Number 84.
