    42SS-1.002Boundary

    PURPOSE AND EFFECT: The Board of Supervisors of the District request that the Commission authorize the amendment of Rule 42SS-1.002, Fla. Admin. Code, in order to expand the District. Expansion of a community development district is authorized by Section 190.046, Fla. Stat.

    SUMMARY: The District's Petition, as supplemented, requests that the Commission authorize the addition of approximately 11.54 acres of land to the existing boundaries of the Tolomato CDD. The lands proposed to be added consist of five parcels of vacated County Road 210 right-of-way in St. Johns County. The lands are geographically located within the District, but were excluded from the District’s boundaries at the time the District was originally established.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.

    A SERC, provided by the District, supports the supplemented petition to expand the Tolomato CDD. The complete text of the SERC is contained as Exhibit 8 to the Petition.

    The Commission has determined that the proposed rule amendment is not expected to require legislative ratification based on the information expressly relied upon and described herein: 1) no requirement for a SERC was triggered under Section 120.54(3)(b) and Section 120.54(1), Fla. Stat.; and 2) there are no adverse impacts or regulatory costs of the rule which will exceed any of the criteria established in Section 120.541(2)(a), Fla. Stat.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

Summary:
The District's Petition, as supplemented, requests that the Commission authorize the addition of approximately 11.54 acres of land to the existing boundaries of the Tolomato CDD. The lands proposed to be added consist of five parcels of vacated County Road 210 right-of-way in St. Johns County. The lands are geographically located within the District, but were excluded from the District’s boundaries at the time the District was originally established.
Purpose:
The Board of Supervisors of the District request that the Commission authorize the amendment of Rule 42SS-1.002, Fla. Admin. Code, in order to expand the District. Expansion of a community development district is authorized by section 190.046, Fla. Stat.
