Construction Industry Licensing BoardNOTICE IS HEREBY GIVEN that Construction Industry Licensing has issued an order disposing of the petition for declaratory statement filed by Pete Quintela, City of Miami Beach Building Department on February 21, 2012. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 38, No. 10, of the March 9, 2012, Florida Administrative Weekly. The Petitioner was seeking the Board to interpret Section 489.105(3)(g), Florida Statutes, and whether it is in the scope of a Class B air conditioning contractor to replace or repair a broken shut-off vale feeding a water cooled 2 ton unit which is connected to the riser of a 500 ton water cooling tower. The Board considered the Petition at a duly-noticed public meeting held on March 16, 2012. The Board’s Order, filed on April 20, 2012, denies the Petition for Declaratory Statement. Petitioner did demonstrate he is substantially affected, as required by Section 120.565, Florida Statues. The petition did not contain sufficient information for the Board to provide a Declaratory Statement.
