NOTICE IS HEREBY GIVEN that Department of Financial Services has received the petition for declaratory statement from Campbell Property Management Corporation on April 17, 2012. The petition seeks the agency’s opinion as to the applicability of provisions of the Unfair Insurance Trade Practices Act, specifically, Section 626.9541(1)(h), Florida Statutes, as it applies to the petitioner.

The petition seeks the agency’s opinion as to whether the provisions of the Unfair Insurance Trade Practices Act, specifically, Section 626.9541(1)(h), Florida Statutes, or any other provision of Chapter 626, Florida Statutes (or rules promulgated thereunder) prohibit its proposal to enter into agreements with insurance agencies whereby the agencies would pay an annual referral fee to the Petitioner for referral of Petitioner’s clients to the agencies for purposes of providing an insurance premium quote.
