14-75.003Minimum Technical Qualification Standards by Type of Work
The Department of Transportation hereby gives notice that on April 29, 2015, the Department of Transportation entered an Order Denying Petition for Variance in response to the Petition for Variance filed by Agenor & Campbell Structural Engineers, LLC d/b/a AC-Structural, seeking a variance from the provisions of paragraph 14-75.003(5)(c), F.A.C., which requires post-tensioned concrete experience by more than one (1) Professional Engineer. The Petition was received by the Department on January 28, 2015. The Department published its notice of receipt of the Petition in the February 6, 2015, edition of the Florida Administrative Register. The Department denied the Petition because AC-Structural failed to demonstrate that the purposes of the underlying statute, Section 287.055(3), Florida Statutes, can be achieved through means other than the strict application of the rule to AC-Structural; and AC-Structural failed to demonstrate that the strict application of paragraph 14-75.003(5)(c), F.A.C., would create a substantial hardship on AC-Structural and would result in an unreasonable and unfair result in this particular instance.
