    62-701.500Landfill Operation Requirements

    The Florida Department of Environmental Protection hereby gives notice that it has issued an order on April 15, 2015, granting Lake Worth Drainage Districts Petition for a Waiver. The Petition was received on December 31, 2014. Notice of receipt of this Petition was published in the Florida Administrative Register on January 5, 2015. The Petition requested a waiver from paragraphs 62-701.500(7)(a), (7)(c) and (7)(e), Florida Administrative Code (F.A.C.), which require Class III landfills provide weekly compaction, side slopes no greater than three feet horizontal to one foot vertical rise (3:1) during operation, and weekly cover. No public comment was received. The Order, file number 15-001, granted the Petition to Rule 62-701.500, F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
