NOTICE IS HEREBY GIVEN that the Florida Building Commission has received the petition for declaratory statement from the City of Winter Park. The petition seeks the agency's opinion as to the applicability of section R405.4.2.2, Florida Building Code, Energy Conservation, 6th Edition (2017), as it applies to the petitioner.

Petitioner seeks clarification about the requirements for energy compliance reports for certificates of occupancy. Specifically: 1) Whether “indicating that the building passes the performance matrix” constitutes the same task as confirming the as-proposed design from R405.3; 2) Whether the information submitted for R405.4.2.1 (compliance report for permit application) may be used for the purposes of R405.4.2.2 (compliance report for certificate of occupancy); 3) Whether the building department needs to request the as-built compliance report if there has been no change to the proposed design during the course of construction and all required inspections to verify compliance have been performed; and 4) Whether the building department needs to request the as-built compliance report if there have been changes to the proposed design during the course of construction, but the compliance report is amended and submitted for review and approval prior to conducting the required inspections.
