    PURPOSE AND EFFECT: The proposed rule amendments clarify the required application criteria, application review process, and notice and posting procedures for municipalities and counties seeking to establish boating restricted areas pursuant to section 327.46(1)(c), F.S. The proposed rule amendments also set forth the right to request an administrative hearing to challenge the agency’s determination of municipalities and counties applications seeking to establish boating restricted areas and update existing documents incorporated by reference. A new petition form is created to be utilized by any person or entity seeking to challenge an agency determination. In addition, the agency is proposing to create Rule 68D-21.005, F.A.C. which sets forth the necessary criteria for establishing seasonal and year-round boating restricted areas.
