    NOTICE OF CORRECTION

    Notice is hereby given that the following correction has been made to the proposed rule in Vol. 39, No. 81, April 25, 2013 issue of the Florida Administrative Register.

    SUMMARY: This rule addresses adoptive family selection for children. This rule is being repealed because it is unnecessary and conflicts with Florida Statutes. The current Rule 65C-16.002, F.A.C., requires the courts to give priority consideration to a grandparent’s petition for adoption. This requirement was repealed from Section 63.0425, F.S. in 2003.

    STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATICIATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. The department used a checklist to conduct an economic analysis and determine If there was an adverse impact or regulatory costs of the rule that exceeded the criteria in Section 120.541(2)(a), F.S.. Based upon this analysis, the department has determined that this chapter will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The department used a checklist to conduct an economic analysis and determine If there was an adverse impact or regulatory costs of the rule that exceeded the criteria in Section 120.541(2)(a), F.S.. Based upon this analysis, the department has determined that the proposed rule is not expected to require legislative ratification.
