NOTICE IS HEREBY GIVEN that Florida Real Estate Commission has issued an order disposing of the petition for declaratory statement filed by Aaron F. Miller on March 17, 2015. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 41, No. 61, of the March 30, 2015, Florida Administrative Register. The Commission considered the Petition at a duly-noticed public meeting held on April 14, 2015. The Petitioner sought the Commission’s opinion regarding whether the exemption provided in subsection 61J2-3.008(8), F.A.C., applies to both sales associates and brokers. The Commission denies the petition because the exemption provided in subsection 61J2-3.008(8), F.A.C., applies only to sales associates.
