The Department of Environmental Protection, Coastal Construction Control Line Program hereby gives notice that on June 3, 2015, it issued an order granting John and Valerie Meyer’s petition for a permanent variance or waiver from subsections 62B-33.002(18) and 62B-33.002(43), and subparagraph 62B-33.0051(1)(a)1, F.A.C. Notice of receipt of the petition was published in the Florida Administrative Register on March 30, 2015. No comments were received in response to the notice.

The Order, OGC #15-0145, CCCL file number SJ-1206 AR V, GRANTED the Petition for a permanent variance or waiver to subsections 62B-33.002(18) and 62B-33.002(43), and subparagraph 62B-33.0051(1)(a)1, F.A.C., based on a showing that Petitioners demonstrated that a strict application of the rules would result in substantial hardship to Petitioners or would violate principles of fairness because they would affect Petitioners differently than other similarly situated persons, and because Petitioners demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
