    PURPOSE AND EFFECT: The Petition filed with the Commission proposes expansion of the Bella Collina Community Development District.

    SUMMARY: Petitioner requests authorization to expand the existing boundaries of the District by adding a 5.11 acre parcel to the existing boundaries.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    However, a statement of estimated regulatory costs (SERC) was prepared at the request of the District as required by 190.005(1)(a)(8), FS. The complete text of the SERC is contained as Exhibit 8 to the Petition. Generally, the SERC supports the Petition to expand the boundaries of the District. The SERC generally finds:

    • The expansion is unlikely to have adverse impact on economic growth, business competitiveness or increased regulatory costs;

    • The individuals and entities like to be required to comply with the administrative rule or affected by the proposed expansion are categorized as follows: (a) the State of Florida, (b) Lake County, (c) property owners within the District, and (d) the property owners of the expansion parcel;

    • There are only modest costs expected to be incurred by the State of Florida, Lake County, and the property owners within the District and the expansion parcel;

    • The transactional costs associated with the adoption of an administrative rule to expand the District’s boundaries are expected to be nominal; and

    • Expansion of the District should not have any negative impact on small businesses.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: Legislative ratification is not required based on the statement of estimated regulatory costs.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
