40E-6.221:Conditions for Issuance of Standard Permits

NOTICE IS HEREBY GIVEN that on June 7, 2013, the South Florida Water Management District (“District”), received a petition for waiver from CenturyLink, Application No. 13-0604-1M, to modify Right of Way Occupancy Permit No. 13784, for utilization of Works or Lands of the District known as CR 951 Canal, for the proposed installation of an aerial crossing within Works or Lands of the District; Section 34, Township 50 South, Range 26 East, Collier County. The petition seeks relief from subsection 40E-6.221(2) and paragraph 40E-6.221(2)(j), Fla. Adm. Code, which governs the minimum vertical clearance requirement for non-voltage aerial crossings within the Works or Lands of the District.
